Notice of SEPA Threshold Determination of Nonsignificance and Notice of Planning Commission Public Hearing for Code Amendments Related to Chapter 12.60.050 Design Deviation and Design Variance, Chapter 13.25.050 Drainage Review Deviations and Design Variances November 5

NOTICE IS HEREBY GIVEN that the Covington Planning Commission will hold a public hearing for consideration of amendments to Chapter 12.60.050 Design Deviations and Design Variances and Chapter 13.25.050 Drainage Review Deviations and Design Variances of the Covington Municipal Code (CMC). The Planning Commission’s public hearing will take place on Thursday, November 5, 2020, at 6:30 p.m, and will be held telephonically and virtually to protect the health and safety of staff and citizens. This public hearing notice was issued on October 22, 2020; therefore, it was not known whether Governor Inslee’s Proclamation 20-28 (which, among other things, suspended various requirements under the Open Public Meetings Act (“OPMA”), Chapter 42.30 RCW, and prohibited public agencies from conducting meetings in person through November 9, 2020) would be extended/amended to encompass the date of this meeting. If the OPMA suspension is not extended through the date of this meeting, the Planning Commissioners will still participate in the meeting telephonically and virtually; however, the city will also provide council chambers at 16720 SE 271st Street, Suite 100, Covington, WA 98042 for in-person participation. For the health and safety of staff and citizens, the city encourages all citizens to participate telephonically and virtually. The potential provision of a physical location for this meeting does not permit or allow citizens to violate any order restricting or prohibiting physical gatherings.

Description of Proposal: The City is in the process of amending Chapter 12.60.050 Design Deviations and Design Variances and Chapter 13.25.050 Drainage Review Deviations and Design Variances of the Covington Municipal Code. The purpose of this amendment is to correct inconsistent code sections associated with the processing of Design Deviations and Design Variances associated with the City Design and Constructions standards, including stormwater, drainage, and streets.

SEPA Threshold Determination:
The City of Covington (lead agency for this proposal) has determined that this proposal does not have a probable significant adverse impact on the environment that cannot be mitigated through compliance with the conditions of the Covington Municipal Code and other applicable regulations. An environmental impact statement (EIS) is not required under RCW 43.21C.030(2)(c). This decision was made after a review of a completed environmental checklist on file with the lead agency. This information is available to the public for reference online via Citizens Connect: permits.covingtonwa.gov/citizen. Search SEPA20-05, or on request at the offices of the City of Covington Community Development Department at 16720 SE 271st Street, Suite 100, Covington, WA, or by contacting permitservices@covingtonwa.gov. There is no administrative appeal of a DNS associated with a legislative decision per CMC 16.10.210.

This SEPA Determination of Non-Significance (DNS) is issued under WAC 197-11-340. Notice is hereby provided for the SEPA action for a non-project GMA Action. The lead agency will not act on this proposal for 14 days from the date of publication of the notice of DNS, allowing time for public comment. The issuance of this DNS should not be interpreted as acceptance or approval of this proposal as presented. The City of Covington reserves the right to approve or deny said proposal subject to conditions if it is determined to be in the best interest of the City and/or necessary for the general health, safety, and welfare of the public.
